This Privacy Policy (“Policy”) discloses the privacy practices for the Carbon mobile application, mobile software, mobile services, other interactive services, and related websites (“Carbon”). 3Good LLC, the provider of Carbon (referred to as “us,” “we,” “3Good”), is committed to protecting your privacy online.

You must be at least 18 years old to have our permission to use Carbon.

You acknowledge that this Policy is part of our Terms of Use , and by accessing or using Carbon, you agree to be bound by all of its terms and conditions. Unless otherwise defined in this Policy, capitalized terms used shall have the meanings assigned to such terms in the Terms of Use. IF YOU DO NOT AGREE TO THESE TERMS, AS UPDATED, PLEASE IMMEDIATELY STOP ACCESSING CARBON.

We reserve the right to change this Policy at any time, without prior notice to you. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, issuing an e-mail to the e-mail address listed by registered users or posting the revised Policy on this page. You acknowledge and agree that it is your responsibility to maintain a valid e-mail address as a registered user, review Carbon and this Policy periodically, and be aware of any modifications. Your continued use of Carbon after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

This Policy applies only to information we collect in Carbon and, in email, text, and other electronic communications sent through or in connection with Carbon.

This Policy DOES NOT apply to information that:

Carbon and applications, and these third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

1. What information do we collect from you?

In order to better provide you with our services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using Carbon.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on Carbon, such as registering for a membership, requesting or providing a ride, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form. It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including zip code), e-mail address, telephone and facsimile numbers, geolocation, and other personal identifying information. We may also collect and store personal information about other people that you provide to us through your use of Carbon. Other than as described in this Policy, we will not intentionally sell or otherwise disclose contact information that you submit to any third party.

Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on Carbon in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the website’s Uniform Resource Locator (“URL”) that you just came from, which URL you go to next, what browser you are using, and your Internet Protocol (“IP”) address. An URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet.

2. Where do we collect information from you and how do we use it?

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. For example, you provide certain Personally Identifiable Information to us when you:

(a) register for our services and register your e-mail address with us;

(b) send messages, submit forms, or other user content, or transmit other information through use of Carbon; or

(a) use Carbon to request or provide a ride.

We may also collect information from you at other points on Carbon that state that such information is being collected.

In addition, we may also automatically collect, or our third party ad server and/or content server may collect, certain Non-Personally Identifiable Information. This information may include browser type, operating system, the page served, the time, the source of the request, the preceding page viewed, and other similar information. This information is ultimately stored in the form of store categories, and, in some cases, specific URLs. We use your IP address to diagnose problems with our servers and software, to administer Carbon, and to gather demographic information. Our third party ad servers will also provide us with summary, but not individual, reports that will tell us how many ads were presented and clicked upon at Carbon. We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

We will primarily use your Personally Identifiable Information to provide our services to you, carry out your requests, remember information so you will not have to re-enter it during your visits or the next time you visit Carbon, respond to your inquires, and in any other way naturally associated with how you provided the information. We will also use Personally Identifiable Information to enhance the operation of Carbon, provide services, improve our marketing and promotional efforts, statistically analyze website use, improve our product and service offerings, and customize Carbon’ content, layout, and services. We may use Personally Identifiable Information to deliver information to you that you have requested or agreed to receive and to contact you for a variety of reasons including, but not limited to, information you have posted or shared with us or changes to Carbon and its policies.

3. What do we do with your payment information?

To use certain services, such as to pay for rides obtained through Carbon, we may require credit or debit card account information. By submitting your credit or debit card account information through Carbon, you expressly consent to the sharing of your information with the Vendors, third-party payment processors, and other third-party service providers (including but not limited to vendors who provide fraud detection services to us and other third parties) in order to carry-out the function requested by you. When you use a credit or debit card to make a payment through Carbon, we provide your credit or debit card account information (including card number and expiration date, but excluding the CVV number) to our third-party payment service providers and the applicable Vendor. These third parties may store your credit or debit card account information so you can use our Payment Services through Carbon in the future.

3Good takes reasonable steps to help protect your personal information in an effort to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. When your credit or debit card account information is being transmitted to Carbon or through Carbon, it will be protected by encryption technology, such as Secure Sockets Layer (SSL).

To be clear, 3Good does not itself store your credit or debit card account information, and we do not have direct control over or responsibility for your credit or debit card account information. Our contracts with third parties that receive your credit or debit card account information require them to keep it secure and confidential.

Nonetheless, we cannot guarantee that transmissions of your credit or debit card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by 3Good or our third-party service providers. We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control.You play an important role in keeping your personal information secure. You should not share your user name, password, or other security information for your 3Good account with anyone. If we receive instructions using your user name and password, we will consider that you have authorized the instructions.

4. With whom do we share your information?

We do not sell, trade, or rent your Personally Identifiable Information to others without your consent, except as noted in this Policy. We do provide some of our services through contractual arrangements with affiliates, services providers, partners, and other third parties for our legitimate business purposes as permitted by law. We and our service partners use your Personally Identifiable Information to operate Carbon and to deliver their services. For example, we may share your personal information with suppliers who perform services on our behalf; and with vendors or providers who provide us with information necessary to perform services on your behalf. 

In addition, we may share your Personally Identifiable Information with third parties who assist us in using the content or other information you have posted or shared with us via Carbon (e.g., production companies we may use). Further, we may share your Personally Identifiable Information with third parties, such as our co-promotional partners and others with whom we have marketing or other relationships. Except as provided in this Policy, our Terms of Use, or as set forth when you submit the information, your Personally Identifiable Information will not be shared or sold to third parties without your consent.

We will encourage our service partners to adopt and post privacy policies. However, the use of your Personally Identifiable Information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful.

5. What about the information I post on blogs, boards, and forums?

We may offer chat rooms, message boards, bulletin boards, or other public forums where you and other users can communicate. The protections described in this Policy do not apply when you provide information (including Personally Identifiable Information) in connection with your use of these public forums. We may use Personally Identifiable Information and Non-Personally Identifiable Information to identify you with a posting. Any information you share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Policy and may result in unsolicited messages from third parties. If you do not want your comments to be viewed by third parties, you are advised not to make any submissions. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through Carbon. Please be careful and responsible whenever you are online.

6. How can you update or correct your Personally Identifiable Information?

We believe you should have the ability to access and edit the Personally Identifiable Information that you have provided to us. You may also access and correct your personal information and privacy preferences by writing us at:

Please include your name, address, and/or e-mail address when you contact us.

We encourage you to promptly update your Personally Identifiable Information if it changes. You may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on Carbon. In addition, it may be impossible to completely delete your information without some residual information because of backups.

7. What are your choices regarding collection, use, and distribution of your information?

We may, from time to time, send you e-mails regarding our products and services. In addition, if you indicated upon registration that you are interested in receiving offers or information from us and our partners, we may occasionally send you direct mail about products and services that we feel may be of interest to you. Only 3Good (or agents working on behalf of 3Good and under confidentiality agreements) will send you these direct mailings and only if you indicated that you do not object to these offers. If you do not want to receive such mailings, simply tell us when you give us your personal information. Or, at any time you can easily edit your account information to no longer receive such offers and mailings.

You also have choices with respect to cookies, as described below. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of Carbon may not work properly in your case.

8. What security precautions are in place to protect against the loss, misuse, or alteration of your information?

At Carbon you can be assured that your Personally Identifiable Information is secure, consistent with current industry standards. The importance of security for all Personally Identifiable Information associated with our user is of utmost concern to us. Your Personally Identifiable Information is protected in several ways. Access by you to your Personally Identifiable Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected 3Good personnel and contractors have access to via password. We encrypt your Personally Identifiable Information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us.

Personal information that you provide that is not Personally Identifiable Information also resides on a secure server and is only accessible via password. Since this information is not accessible from outside 3Good you will not be asked to select a password in order to view or modify such information.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through Carbon cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

9. Do we use “cookies”?

When you use Carbon we and/or a third party vendor will store cookies on your computer or mobile phone in order to facilitate and customize your use of Carbon. A cookie is a small data text file, which a website stores on your computer’s or mobile phone’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us. The cookies may store randomly assigned user identification numbers and the country where you are located. The cookies make your use of Carbon easier, make Carbon run more smoothly, and help us to maintain secure Websites. You are always free to decline our cookies if your browser permits, but some parts of Carbon may not work properly in that case.

We may use an outside ad serving company to display banner advertisements on Carbon. As part of their service, they will place a separate cookie on your computer. We will not provide any third-party ad server with any of your Personally Identifiable Information. Our third party ad server and we will collect and use Non-Personally Identifiable Information about you, such as your IP address, browser type, the server your computer or mobile phone is logged onto, the area code and zip code associated with your server, and whether you responded to a particular ad. Other advertisers may also place banner ads on Carbon in the same manner as above, but we will not disclose any Personally Identifiable Information to them.

1o. What should you know about privacy policies and data collection at any third party Websites accessible from Carbon?

Except as otherwise discussed in this Policy, this document only addresses the use and disclosure of information we collect from you. Other websites accessible through Carbon have their own privacy policies and data collection, use, and disclosure practices. Please consult each website’s privacy policy. We are not responsible for the policies or practices of third parties. Additionally, other companies which place advertising on Carbon may collect information about you when you view or click on their advertising through the use of cookies. We cannot control this collection of information. You should contact these advertisers directly if you have any questions about their use of the information that they collect.

11. What else should you know about your privacy online?

Our policy is that we do not knowingly collect, use, or disclose Personally Identifiable Information about visitors that are under 18 years of age. We comply with the requirements of the Children’s Online Privacy Protection Act. We do not collect any information from anyone under 13 years of age.

Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information, as defined under California law, during the preceding year for third party direct marketing purposes. You are limited to one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. You may request the information in writing as provided in this section.

Some web browsers incorporate a “Do Not Track” feature that signals to websites that you visit that you do not want to have your online activity tracked. California residents are entitled to know how 3Good responds to “Do Not Track” signals. How browsers communicate the Do Not Track signal is not yet uniform so a standard technological response has not yet been developed by the appropriate technology communities. For this reason, we do not respond to Do Not Track signals currently. To opt out of targeted advertising on Carbon, please send a request to the address above. The effect of an opt-out will be to stop targeted advertising, but it will still allow the collection of usage data for certain purposes (e.g., research, analytics, and internal online services operation purposes).
